Mike Tyson is being accused of raping a woman after the two met at an Albany night club in the early 1990s, according to the unidentified plaintiff’s $5 million lawsuit filed earlier this month.  

The woman claims Tyson raped her in a limousine, resulting in ‘physical, psychological and emotional injury’ in the years since then.

‘I got in Tyson’s limousine to pick up my friend from her house,’ read the lawsuit, obtained by DailyMail.com. ‘Tyson immediately started to touch me and attempted to kiss me. I told him no several times and asked him to stop, but he continued to attack me. He then pulled my pants off and violently raped me.’

The woman’s filing does not include a specific date for the attack other than the ‘early 1990s’ – around the same time that beauty pageant contestant Desiree Washington said Tyson raped her in Indianapolis. Tyson was convicted of raping Washington on February 10, 1992, and served three years in prison.

The legal action in New York was filed under the state’s Adult Survivors Act, which gives sexual assault victims a one-year window to file lawsuits over assaults that happened years or even decades ago.

The woman is seeking to maintain her anonymity because, she said, publication of her name ‘would certainly pose a risk to me of further mental harm, harassment, ridicule or personal embarrassment.’

She also shared her the emotional she claims she suffered as a result of the alleged attack.  

‘As a result of Tyson’s rape, I suffered and continue to suffer from physical, psychological and emotional injury,’ read the filing. ‘I have experienced feelings of guilt, loss of self-respect, shame, embarrassment, sadness, anger, depression, anxiety, violent tendencies, drug and alcohol addiction and confusion resulting from the brutal rape. 

‘I have developed lifelong problems including but not limited to issues with sex, and with being touched as a result of the rape. I have been unable to maintain and/or develop healthy relationships with men or anyone in general. I have experienced extreme emotional suffering including but not limited to nightmares, panic attacks and flashbacks.’

The woman’s attorney, Darren Seilback, said in a separate filing that his office did not simply take the woman at her word but investigated her allegations and determined that they are ‘highly credible.’

Seilback said Tuesday he could not comment further on the case.

Tyson’s spokesperson did not immediately respond to DailyMail.com’s request for comment.  

Brooklyn-born Tyson, 56, won adulation as the undisputed world heavyweight champion from 1987 to 1990, but his life outside the ring has been turbulent.

Tyson’s former wife, actor Robin Givens, said in divorce papers that their late-1980s marriage was characterized by ‘unprovoked rages of violence and destruction.’

He was also accused of groping his former photographer.

Tyson allegedly tried to grab the breast of award-winning photographer Lori Grinker in the early 1980s, but rather than denying the claim, he told DailyMail.com that the two had a consensual sexual relationship starting when he was ‘around 17’ and she was in her mid 20s. 

Grinker, 65, made her accusation in the preface of her new pictorial book, ‘Mike Tyson,’ a candid collection of photographs from Tyson’s teenage years in through the early 1990s.

‘Mike could be very sweet and gentle when he was feeling it, and not very sweet or gentle when he wasn’t,’ she wrote about Tyson, who is now 56. ‘He once tried to grab my breast, and when I pushed him away, he got angry and threw my light meter in the snow. He had a somewhat spoiled side and, being the champ, grew accustomed to getting his way.’

In emails to DailyMail.com, Grinker said Tyson never tried anything like that again and the two continued with their professional relationship. She also stressed that Tyson was just an ‘immature teenager’ at the time. 

Tyson’s representatives responded to DailyMail.com’s request for comment in October with a statement: ‘In this day and age it’s unfortunate that Ms. Grinker was not more careful with her words omitting the fact that she was in a sexual relationship with Mike Tyson when he was a minor with almost a decade age difference.’

Grinker has told DailyMail.com that Tyson’s claim is inaccurate and a lie.

In a separate email to DailyMail.com, Tyson’s spokesperson indicated that the alleged relationship began around 1983: ‘He was around 17 and had sexual relationship (sic) with her on & off until about 21. He had sex with her also when he was champion in Atlantic City.’

Although Tyson’s spokeswoman initially described him as a ‘minor’ at the time the alleged sexual relationship supposedly began, she later explained that ‘minor is generally legally defined as a person under the age of 18.’

If the alleged affair did occur when Tyson was 17, it would not have violated New York State consent laws enacted in 1965. 

The incident hardly typifies their time together in the 1980s, much of which Grinker enjoyed.

The two met when he was a 13-year-old, recently released from a reformatory, where he was discovered as a budding boxing prodigy. Tyson had been adopted by trainer Cus D’Amato, who once guided Floyd Patterson to the heavyweight title in the 1960s, and was living in the boxing legend’s Catskill, New York home with other aspiring fighters.

Grinker, a college student at the Parson School of Design in New York in 1980, was on a photography class assignment, which brought her to D’Amato’s Victorian home and gym in the Hudson Valley.

TYSON AND GRINKER: CLAIMS AND COUNTERCLAIMS 

Grinker’s initial claim: In her new pictorial book, ‘Mike Tyson,’ award-winning photographer Lori Grinker, 65, says the now-56-year-old boxing legend attempted to grab her breast as the two worked together in the early 1980s.

‘He once tried to grab my breast, and when I pushed him away, he got angry and threw my light meter in the snow,’ Grinker wrote. 

Response from Tyson reps: When asked for a response to her claims by DailyMail.com, a Tyson spokesperson accused Grinker of having a sexual relationship with Grinker when he was a minor and she was an adult. 

‘In this day and age it’s unfortunate that Ms. Grinker was not more careful with her words omitting the fact that she was in a sexual relationship with Mike Tyson when he was a minor with almost a decade age difference,’ read the statement. 

The Tyson spokesperson later added: ‘He was around 17 and had sexual relationship (sic) with her on & off until about 21. He had sex with her also when he was champion in Atlantic City.’ 

Grinker responds to Tyson: In an email to DailyMail.com, Grinker described Tyson’s claim of a sexual relationship as ‘inaccurate’ before going on to make an additional statement.

‘It’s not surprising, though regrettable, that in the guise of what the Daily Mail writer terms is ”integrity” he chose to focus out of context on a brief moment I used to mark a time in Mike’s life as an immature teenager as I documented Mike’s hard-fought, meteoric rise to a settled, thoughtful world champion,’ Grinker wrote. ‘Working a path of salaciousness and merely to gin up controversy, the writer has purportedly prompted a Tyson spokesman to reply inaccurately and with a lie that is, in fact, libelous. My homage to Mike Tyson speaks for itself.’

Even casual fans know the legend of Tyson, who famously escaped poverty in Brooklyn to win his first 37 professional fights while becoming one of the most recognizable – and feared – boxers of any era. 

Abandoned by his father at birth, and orphaned at 16 when his mother passed away, Tyson grew up in Brooklyn’s rough Brownsville neighborhood in the 1970s and had the physical and emotional scars to prove it. According to several accounts, Tyson was targeted for his short stature and his lisp throughout his childhood, as well as his love of pigeons. In one instance, an older child once ripped the head off one of Tyson’s birds, prompting the future champ to discover his punching power.

‘This man was a killer,’ late boxing writer Bert Sugar once said of Tyson, who twice beat opponents in just eight punches. 

But for all his success, Tyson will be equally remembered for his 1992 rape conviction, his subsequent three-year prison sentence, and his 1997 disqualification for biting opponent Evander Holyfield in the ring. He was accused of domestic abuse by his first wife, Givens, admittedly battled a cocaine problem in his 40s, and filed for bankruptcy in 2003 after squandering roughly $300 million in career earnings. 

In recent years, Tyson has enjoyed renewed popularity, thanks to an exhibition fight against former multi-weight champion Roy Jones Jr.,  as well as his newfound role as a proponent of legalized marijuana.
